What Virginia law actually says.

Under Va. Code § 55.1-1226, your landlord has 45 days — measured from the later of the termination of your tenancy or the date you vacate — to return your security deposit along with a written, itemized statement of any deductions. (A narrow 15-day extension exists, but only where the damages exceed the amount of the deposit AND require a third-party contractor, and the landlord notifies you in writing within the 45 days.)

Virginia does not apply a flat 2× or 3× multiplier. Where the failure to comply is willful, the court must order:

  • Return of the security deposit to you
  • Your actual damages on top

So a landlord who willfully sits on your deposit past the 45-day deadline faces a mandatory order to return it, plus your actual damages. Most landlords return it quickly once they realize the exposure.

Good to know: Virginia caps security deposits at two months’ rent. Interest is owed only if the landlord owns more than ten units and holds the deposit longer than 13 months. Unclaimed deposits pass to the State Treasurer after one year.

If you owe rent: Under § 55.1-1226(E), where the tenant owes rent, the court credits the deposit against the rent due instead of ordering it returned — so unpaid rent changes what a Virginia deposit claim can recover. Provide your forwarding address in writing (your letter does): without one, the landlord may simply continue holding the deposit in escrow, and after a year may remit it to the State Treasurer as unclaimed property.
